These Terms of Use (‘Terms’) apply to all Members and users of this website and our Services. We may modify and update these Terms at any time, without notice. You need to ensure you review the Terms from time to time. By using our website and Services, you agree to be bound by these Terms as well as any and all general Terms and Conditions posted on our website from time to time.

“Materials” includes e-courses, reports, audio, literature, DVDs, written documents, questionnaires, videos, or other material which may be provided to assist and enable the Services to be performed.

“Member” means a member to the Services accessed on or through the website.

“Services” means providing access to online courses on general business, operations, management, maintenance, reliability compliance, and other related information delivered via online our website.

“We”, “our” and “us” means R2 Reliability Pty Ltd (ABN 96624299672) roadtoreliability.com and includes all officers, directors, employees, contractors and affiliates.

“You” means a Member, client or any user of our Services and by doing so, agree to these Terms.

HOW IT WORKS

We offer various courses delivered online to clients to assist and educate in the areas of general business, operations, management, maintenance, reliability, planning and scheduling and other related areas.

The courses are offered for varying periods with no minimum time limit to complete the course. Clients are to register and sign up for the various courses and make payment according to the course chosen.

MEMBERSHIPS FOR ONLINE COURSES

You need to first fill in your registration details that are required in the online form to gain access to one of our membership plans or courses. Depending on your choice of membership plan or course, you must pay the membership fee or course fee in advance in order to sign up to our website to access our courses, information and any associated services.

By providing your credit card details, you authorise us and agree to any instalment membership fee being automatically deducted from your credit card or other nominated payment method when payment is due unless you or we cancel the membership in accordance with the below Cancellation terms.

When join to our website and use our Services, you acknowledge and agree to the following:

INFORMATION PROVIDED TO PERFORM THE SERVICES

We may request information that will be considered Confidential Information which we require to perform the Services. We will at all times keep your Confidential Information confidential, secure and we agree will not use or disclose directly or indirectly any personal information, data or Confidential Information which relates to, arises under or is acquired as a consequence of performing the Services unless required by law or with your express written consent.

We will not at any time disclose or allow access by any person or third party to any of the Confidential Information unless required to perform the Services in which case, we will ensure they are under the same duty of confidentiality as we are.

DISCLAIMER

In providing our Services, we are providing you with education, information, insights and ideas only, in order to assist you in your business. You need to decide what may work best for your own business needs and should make your own assessment after careful consideration of your situation and business model.

We also do not guarantee that any information in our online courses and Services will result in any increase in revenue, improve any operations or output, or make any guarantee at all about your business. Results vary from business to business depending on the commitment to the work, training, type of business and how any systems or procedures may be implemented. We do, however, provide our experience, insights, perspectives and recommendations in order to assist you to consider options for your business which may have an overall positive impact and help you with your business needs.

In particular, Members should, before using and relying on any courses or training, or utilizing any Materials consider their own organizational and business needs. Members take full responsibility and risk for making any decisions based on any Materials including, in particular, all information contained in our courses.

COPYRIGHT AND CONFIDENTIALITY IN COURSE MATERIAL

The course material, such as instruction manuals and training exercises, including online training and self-paced course material, is protected by copyright and cannot be copied by you or any other person, without our express written permission.

In particular, you may not share, copy or redistribute this Material in any medium or format at any time. Our Materials are for your individual personal use only and may not be used for commercial purposes. You are not permitted to make any derivative material, including but not limited to copying, reproducing, transforming, sharing or building upon the material in whole or any part thereof. For any other use or distribution, you must have express written consent from roadtoreliability.com.

All training course material provided to you, or presented to you during the training course, is our confidential proprietary information for the sole use of you as the person participating in the course.

GENERAL

We make no warranty that the website services will meet your requirements or be available on an uninterrupted, secure or error-free basis. We will use our best endeavors to ensure the website is always available and virus free but from time-to-time, and in some instances, this may not be the case as it may be out of our immediate control. We will endeavor to notify you if the website becomes unavailable for any lengthy and unusual time period.

You agree and acknowledge that the website uses third party vendors and hosting partners to provide the necessary software, hardware, service and storage.

You agree you will not transmit any viruses, malware, worms, etc. of any kind and that you will not upload, post, host or transmit unsolicited material or messages to the website.

CANCELLATION, REFUND, AND TERMINATION

CANCELLATION AND REFUND: You can cancel your membership or course access at any time within 30 days of payment in writing. You must cancel your membership in writing by notifying us at [email protected] requesting a refund with your reason for cancellation.

You need to also provide notice 30 days prior to any installment payment date if you have chosen any installment payment plan or you will be charged for that period.

You may also cancel at any time after this 30-day period but unfortunately, we do not offer any refunds after this time. We do, however, at all times abide by the Australian Consumer Law in relation to any guarantees for our Services.

WE MAY TERMINATE YOUR MEMBERSHIP OR COUSE ACCESS AT ANY TIME: We may, in our sole discretion, terminate or suspend your access to the website with or without notice and for any reason, including, without limitation, breach of these Terms. Any suspected fraudulent, abusive or illegal activity may be grounds for terminating your relationship and may be referred to the appropriate law enforcement authorities.

Upon such termination, regardless of the reasons, your right to use the website immediately ceases and you acknowledge and agree we may immediately deactivate or delete your account and all related information and files. We may also bar you from any further access to our website. We shall not be liable to you or any third party for any claims or damages arising out of any termination or suspension or any other actions taken by us in connection with such termination or suspension.

We are not required to provide any refund or part thereof to you for such termination of your membership.

OWNERSHIP OF INTELLECTUAL PROPERTY

Materials may be provided to clients from time to time during and to enable provision of the Services. All Materials are provided without warranties of any kind, both express and implied. Any Materials, designs, analyses, processes, discussions and other intellectual property, both tangible and intangible which is provided or may be developed as a result of or during the Services is and will remain the property of the R2 Reliability Pty Ltd. at all times. No materials may be reproduced or used for any purpose other than the personal private use of the individual client. At no time may it be reproduced and provided to third parties without the express written permission of R2 Reliability Pty Ltd.

MODIFICATION OF WEBSITE AND CONTENT

We reserve the right at any time and from time to time to remove, delete, alter, or amend any Content, Services, or the website. In particular, if we believe the Content to be inappropriate, potentially breach regulations, receive complaints, or for any other reason and in our reasonable discretion, we may remove or modify Content at any time without notice. We shall not be liable to you or any third party for any modification when it is required.

We reserve the right to disclose your name and any other personal details to any law enforcement authority or other competent authority or to any person for the purpose of legal proceedings, prosecution, investigation, or any breach, alleged breach of the law or these Terms.

While we endeavor to keep the website up-to-date and correct, we make no representation or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability or availability with respect to the Services for any particular purpose and provide it for your informational purposes and out of our own analysis. Any reliance you place on such information is therefore strictly at your own risk.

LIABILITY

You agree and acknowledge that we are not liable for any direct, indirect, consequential, or incidental loss or damage which may result from your use of our website, the Services, or any information contained on it or linked to it.

In using our Services, you agree you are doing so at your own risk and we cannot be held responsible for the action you may decide to take based on your decisions or actions that may result from our Services. You agree that some Services may involve financial or other personal management discussions. Services: To the extent we are unable to exclude liability; our total liability for loss or damage you suffer or incur from our Services is limited to us re-supplying the Services to you, or, at our option, us refunding to you the amount you have paid us for the Services to which your claim relates.

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

INTELLECTUAL PROPERTY

All custom graphics, icons, logos and service names in our courses or Materials are registered trademarks, copyright, trade or service marks of roadtoreliability.com.

Nothing in these Terms grants you any right to use any trademark, service mark, logo, and/or our name or any thing you access through our Services.

You agree and acknowledge that we retain all right, title and interest in the Services, including but not limited to the inventions and intellectual property rights contained or embodied within the Services.

You have been provided with a limited license to use the Materials, courses, information and Services only for the purposes notified to you and included in these Terms. Any other use, including but not limited to, commercial use, provision to a third party in whole or in part, or reproduction in any manner, breaches the license provided to you under these Terms and our copyright.

You are solely responsible for obtaining written permission before re-using any copyrighted material that is available in these courses or our Materials. Any unauthorized use of the Materials may violate copyright, trademark, and other applicable laws and could result in criminal or civil penalties.

GOVERNING LAW

These Terms of Use are governed by the laws of Queensland which are in force from time to time and both you and we agree to submit to the exclusive jurisdiction of the Courts of Queensland for determining any dispute concerning these Terms.
